OMEGA Pilzno International Transport & Spedition Godawski & Godawski Sp. z o.o. with the registered office in Pilzno and companies being included in the OMEGA PILZNO Capital Group (hereinafter referred to as the OMEGA PILZNO Group) make any possible efforts in order to provide security to personal data being entrusted for us, being aware of the fact that personal data have got a value and they need to be protected appropriately. The priority of the OMEGA Group is informing you about matters connected with personal data processing, considering the contents of the personal data protection regulations being in force, including in particular the Directive of the European Parliament and Council (EU) 2016/679 of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on a free data flow and the repeal of the Directive number 95/46/WE (“RODO”).
The privacy policy constitutes a synthesis of legal bases on personal data processing, ways of processing them and the rights entities whose personal date are being processed are entitled to. Whenever we process personal data on the basis of a legally justified interest of the data administrator, we try to analyze and balance our interest and a potential impact on the person that the data concern (both positive and negative one) as well as the rights of such person. We do not process personal data when we come to a conclusion that the impact on the person that the data concern, would prevail over our interest, unless we have a different legalizing ground, e.g. we possess an appropriate agreement or it is required or allowed by legal regulations.

IV. Personal data processing operations
1. Personal data processing by persons visiting Internet websites run by the OMEGA PILZNO Group or using services provided by electronic means.
a) general information
Natural persons who visit Internet websites of the OMEGA PILZNO Group or use services provided the OMEGA PILZNO Group by electronic means have a control over personal data which they submit to us. Collecting and using information about the users is limited to the necessary minimum, required to provide services for them.
b) Log files
Whenever an Internet website is being called up, our system automatically gathers data and information from the computer system of the computer, which opens the page. The following data are collected:
- Information on the type of the browser and the version being used,
- The user’s operational system,
- The user’s IP address,
- Date and time of calling up the website,
- Internet websites from which the User’s system went to our Internet website (the so-called referrer),
- Internet websites which were called up by the user’s system via our Internet website.
Data are also recorded in our system’s log files. Recording data together with other personal data of the user does not take place. On the basis of such data it is not possible to identify a given person, because the IP address is only available in a hidden form. The transferred data are also stored and processed in order to analyze errors and for statistical purposes in the log file. Temporary recording of the IP address is necessary in order to enable the website for the computer user. For that purpose the user’s IP address has to be recorded for the duration of the session. The purposes of recording in log files is to provide functionality of the Internet website. Moreover, data are used to optimize the Internet website and to provide security for our IT systems. Data analysis for marketing purposes does not take place.
c) Cookies files
We can collect personal data automatically via cookies files which are on our Internet websites to a limited extent. Cookies are small IT data files, recorded and stored on a computer, tablet or smartphone, for the purpose of using Internet websites. “Cookies” usually include the name of the website, where they come from, the time of storing them on the device and a unique number. Cookies files are used for the purposes of:
- Adjusting Internet websites to the user’s preferences and optimization of using Internet websites;
- Customization of the content displayed for a particular user of the service;
- Creating statistics, explaining the ways of using Internet services by the users, which enables to improve their construction and website content;

Three types of cookies files are used: “session cookies”, “permanent cookies” and “third-party cookies”. “Session” cookies are temporary files stored on the user’s computer, tablet or smartphone until logging out, leaving the page or closing the Internet browser and they are used for maintaining services requiring authentication within a give Internet website. “Permanent” files are stored on the computer, tablet or smartphone for a period of time defined in the cookies files’ parameters or until they are deleted by the user and they are used to memorize settings and customization of the interface selected by the user. “Third-party” cookies files enable to collect information about the way of using Internet websites and providing the users with advertising content, optimally adjusted to the interests of particular users.
Personal data collected by means of using cookies are encrypted in order to disable an access to unwanted or unauthorized persons. They are only collected for the purpose of performing particular functions for the user.
The OMEGA PILZNO Group informs that the majority of Internet browsers include settings, which enable accepting cookies by default. If you do not agree for monitoring your activity on the Internet website, you can turn off the functionality of cookies files at any time in your Internet browser. Moreover, you have a right and possibility to make such settings concerning cookies files in your Internet browser, which will automatically block their functionality. Using our Internet website without using cookies is possible, however, in individual situations it may be restricted during the usage. In order to analyze the users’ behavior, we use Google Analytical, Google Inc. network analysis service (hereinafter referred to as “Google”). However, we requested Google to anonymize your IP address before the analysis of the user’s behavior in the network. We have introduced appropriate entries in the Google Analytics software code. Google Analytics uses cookies which are stored on your computer and they enable an analysis of the way of using the Internet website by you. Cookies used by Google Analytics may be temporary files or permanent files, which maximum expiry date usually does not exceed two years. Information used by cookies concerning your usage of an Internet website is usually passed to the Google server in the USA and it is stored there. Considering the IP anonymization being activated by us, your IP address is truncated within European Union member states or other countries being parties of the agreement concerning the European Economic Zone before it is submitted to the Google server in the USA. Only in exceptional cases, on which we do not have an influence, a full IP address is transferred to the Google server in the USA and it is truncated there. Within the scope of our order, Google shall use the aforementioned information for the purpose of evaluating the usage of our Internet website, creating reports on the activity in the Internet website and for the purpose of providing other services for u, connected with using the Internet website and Internet. The IP address submitted by your browser within Google Analytics is not combined with other Google data.
What is important, you may prevent the process of registering and transferring data created by cookies ( Google), concerning your use of the Internet website (including the IP address) to Google, as well as processing such data by Google if you download and install a plug-in to the browser which can be found under the following link: tools.google.com/dlpage/gaoptout .
d) Contact forms
Internet websites of the OMEGA PILZNO Group enable to make a contact with particular companies of the OMEGA PILZNO Group. We use contact and application forms concerning work and cooperation. Within the scope of using the listed questionnaires, it is usually necessary to provide us with your personal data (first name, surname, telephone, e-mail address). The data which are submitted by you in an online form are downloaded, processed and used only within the scope and for the purpose of dealing with your enquiry and their usage takes place only upon your explicit consent.
e) Electronic correspondence
Unencrypted e-mail messages which are sent via the Internet, are not protected sufficiently enough against an unauthorized access of third parties.
2. Personal data processing of people getting in touch with the OMEGA PILZNO Group in order to receive information about the offer or sharing comments concerning services, as well as getting in touch in order to conclude a contract.
We collect the following information from natural persons getting in touch with us in order to obtain information about the offer or sharing comments concerning our services, as well as getting in touch in order to conclude a contract: first name and surname, position, e-mail address and phone number. In particular, those people can send an e-mail to us via the Internet website. Such messages include a set-up user’s name and e-mail address and additional information, which the user wants to include in the message. We would like to ask not to submit information via Internet websites from special categories of personal data listed in art. 9 section 1 of RODO (information concerning the race, political views information concerning religious or philosophical beliefs, belonging to trade unions, information concerning physical and mental health, genetic data, biometric data, information concerning sexual life or sexual orientation and criminal past). In case of providing such information for any reason, it will mean an explicit consent for collecting and using by us such information in a way defined in the foregoing document or defined in a place where such information was disclosed.
3. Personal data processing of customers and potential contractors
The OMEGA PILZNO Group processes personal information of its customers and potential contractors. Among such data there might be also personal data of people connected with our customers, who are not natural persons (e.g. contact persons, data of the members of the authorities of legal persons). Personal data of such type is processed in IT systems for the purposes including among others: first name and surname, employer’s name, position of the contact person, phone number, e-mail address or other official contact data.
4. Personal data processing of end users of online tools
In a situation when we make certain products or services available to the customers online (Internet website), we process personal data of end users of such type of products or services. We wish to point out that information concerning cookies and access logs provided by us earlier is also used for personal data processing of natural persons using the products or services offered online.
5. Personal data processing of transport participants
The OMEGA PILZNO Group processes personal data of transport participants and the information clause for this group of people is put on the Internet website at the address of https://omega-pilzno.com.pl//polityka-prywatnosci/ in the folder “Information clause for transport participants”.
6. Monitoring
On the premises of the facilities/properties, which the OMEGA PILZNO Group uses within the conducted activity there is usually CCTV monitoring. Places where there is CCTV monitoring are marked with an appropriate graphic symbol.
V. Legal bases for processing
1. Personal data processing of persons visiting Internet websites run by the OMEGA PILZNO Group or using services provided electronically is based on different legal bases for processing depending on the category of personal data, which we process and the purpose of the processing. Personal data of persons visiting our Internet websites are processed by us on the basis of a legally justified interest of the data administrator or on the basis of a consent in case when we requested such a consent from a person whom the data concern. Personal data of persons who fill in the Internet/contact form is processed by us because it is necessary for the purpose of executing the contract. Sometimes legal regulations require we process certain personal data for tax and accounting purposes.
2. Personal data processing of persons getting in touch with the OMEGA PILZNO Group for the purpose of obtaining information concerning the offer or sharing comments concerning the services, as well as persons getting in touch in order to conclude a contract takes place based on:
a) a consent expressed by the user addressing the aforementioned request to the OMEGA PILZNO Group or
b) the purpose of executing the contract (realizing the order) reported by a given person or
c) on the basis of a justified purpose of the data administrator.
3. Personal data processing of natural persons – customers of OMEGA PILZNO is based on:
a) a justified interest of the OMEGA PILZNO Group as a data administrator (e.g. within the scope of creating databases, analytical activities, including activities concerning an analysis of using products, direct marketing of own products, protecting documentation for the purpose of defending against possible claims or for the purpose of claiming damages);
b) a consent (including, in particular, a consent for a marketing or telemarketing e-mail);
c) the execution of the concluded contract;
d) obligations resulting from the law (e.g. tax law or accounting regulations).
4. Personal data processing of natural persons who are potential customers is based on:
a) a justified interest of the OMEGA PILZNO Group as a data administrator (especially within the scope of creating databases, direct marketing of own products);
b) a consent (including, in particular, a consent for a marketing or telemarketing e-mail);
c) undertaking actions upon a request of a person, whom the data concern, before concluding a contract.
5. If end users are also customers of the OMEGA PILZNO Group, the legal bases for processing them are the same as with reference to the customers of the OMEGA PILZNO Group as described above. However, if they are not customers, the legal basis for processing personal data is, depending on the situation and the type of personal data, a consent of the natural person or a justified interest of the OMEGA PILZNO Group as a data administrator (e.g. within the scope of providing a service ordered by the customer, within the scope of analytical and profiling activities, including activities concerning an analysis of using products, direct marketing of own products, protecting documentation for the purpose of defending against possible claims or for the purpose of claiming damages).

7. The basis for the personal data processing from monitoring is a justified interest of the data administrator, ensuring employees’ safety and property protection on the area which is being monitored.
VI. The term of data processing
The time through which the companies from OMEGA PILZNO Group process personal data depends on the legal basis legalizing personal data processing.
In case when the OMEGA PILZNO Group processes personal data on the basis of:
- a consent – the processing period lasts till the moment of withdrawing such consent by the person, whom the data concern;
- a justified interest of the data administrator – the processing period lasts till the moment when the aforementioned interest ceases (e.g. the period of the limitation of civil-legal claims) or until an objection of the person whom the data concern to further process such data – in situations when such an objection is authorized in compliance with legal regulations;
- binding legal regulations – the terms of data processing for that purpose are defined by these regulations;
- data from monitoring for the period up to 60 days from recording them or overwriting.
In case of the lack of specific legal and contractual requirements, the basis period for storing data in case of entries and other documentary evidence prepared during the execution of the contract is maximum 10 years.
VII. Data recipients
We disclose personal data to others only if we are permitted to do so by law, while maintaining a high level of security in order to protect this data. We may transfer your personal data to companies or other associates who provide services on our behalf, for example to provide technical support, to assess the suitability of this website for marketing purposes or other types of services. We have entered into agreements with these partners to ensure that personal data is processed on the basis of our guidelines and in line with this Privacy Policy and other appropriate measures to ensure confidentiality and security. VIII. Rights connected with personal data processing
The Companies of the OMEGA PILZNO Group as personal data administrators are responsible for the realization of the rights of natural persons concerning their personal data.
You are entitled to the following rights connected with personal data processing:
- the right to withdraw a consent for data processing if we process your personal data on the basis of a consent,
- the right to have an access to your personal data,
- the right to request to correct your personal data,
- the right to request to delete your personal data,
- the right to request to restrict your personal data processing,
- the right to express an objection towards your personal data processing due to your special situation – in cases, when we transfer your data on the basis of our legally justified interest,
- the rights to transfer your personal data, that is, the right to receive your personal data from us, in a structured, commonly used IT format which is machine-readable; you can send such data to a different data administrator or require that we send your data to a different administrator, However, we will do it only if sending the data in such way is technically possible. The right to transfer personal data applies only to such data which we process on the basis of the contract with you or on the basis of your consent,
- the right to lodge a complaint to supervisory authorities dealing with personal data protection, that is, the President of the Personal Data Protection Authority.

3. Purposes of processing, legal basis for processing and data categories
In order to perform the contract, we need your personal data, in particular your name and surname, address of the apartment, registered office address, tax identification number, contact number, name and surname of persons comprising the bodies of the entity authorized to represent it.
In connection with the above, we will process your personal data:
- to perform the contract (Article 6(1)(b) of the Regulation of the European Parliament and of the Council (EU)2016/679),
- for archival (evidence) purposes, which are the implementation of the legitimate interest of securing information by the administrator in the event of a legal need to prove facts (Article 6 (1)(f) of the Regulation of the European Parliament and of the Council (EU)2016/679);
- to possibly establish, investigate or defend against claims, business and analytical purposes that are the implementation of the legitimate interest of the administrator (the basis of Article 6 (1) (f) of the Regulation of the European Parliament and of the Council (EU) 2016/679).

3. Reasons for processing, the legal basis for processing and data categories:
In order to realize the transport service, your personal data are necessary for us, in particular your first name and surname, address of residence, address of the registered office, NIP number, a contact number and the place of delivery in case of recipients. Therefore, we will be processing your personal data:
- in order to perform the transport contract on the basis of art. 38 section 1 and 2 and art. 50 of the Law of 15 November 1984 Transport Law or the provisions of art. 6 and 7 of the Convention on the Contract for the International Carriage of Goods (CMR) (art. 6 section 1 letter b of the Directive of the European Parliament and Council (EU) 2016/679),
- for archival (evidence) purposes being a realization of a legally justified interest of securing information by the administrator in the event of a legal need to prove facts (art. 6 section 1 letter f of the Directive of the European Parliament and Council (EU) 2016/679),
- in order to possibly determine, sue or defend claims being a realization of a legally justified interest of the administrator (art. 6 section 1 letter f of the Directive of the European Parliament and Council (EU) 2016/679),
- if you are a recipient of a parcel, your personal date will be processed by us in your interest so that you could receive ordered goods or a parcel,
- personal data of our contractors’ employees, who will participate in the realization of the transport service will be processed due to a legally justified interest, that is, the appropriate realization of a transport service (art. 6 section 1 letter c, d, f of the Directive of the European Parliament and Council (EU) 2016/679),
